Infrastructure holds the key to the sustainable development and
growth of a nation. The infrastructure in a country is often viewed
as an indicator to its level of development and a state of the art
infrastructure significantly accelerates its overall growth.
South Asian region has witnessed tremendous growth in the infrastructure
sector in the past few decades. An inevitable consequence of this
phenomenal growth is the increase in the number of disputes associated
with such infrastructure projects.
Having a dispute resolution mechanism which ensures expeditious
resolution of disputes, arising out of any such project, is vital,
not only for the particular project, but also for the sustained
growth of infrastructural projects in the region.
Arbitration, as a method of dispute resolution, is preferred over
litigation for a host of advantages that the former offers to the
parties at dispute. Conventional litigation, as opposed to Arbitration,
is a time-consuming, expensive and complicated mechanism for dispute
resolution. These factors make Arbitration a more commercially viable
and preferred option, since even minor delays in resolving disputes
associated with such commercial projects often result in the parties
suffering huge monetary losses.
International Infrastructure and Construction Law Arbitration Moot
(IICLAM) is an international level arbitration moot competition
attempting to familiarize budding lawyers from around the world
with Arbitration as a system of resolution of commercial disputes
arising out of the various infrastructure and construction projects
around the world. It is with this vision that the three organizers,
Kaden Boriss Partners, National University of Singapore (NUS) and
Singapore International Arbitration Centre (SIAC) came together
to begin an initiative called 'International Infrastructure and
Construction Law Arbitration Moot' (IICLAM).
Pursuant to the successful achievement of IICLAM in 2007 and 2008, the third competition in this series (3rd IICLAM, 2009) is being organized from the 13th to 15th November 2009 in New Delhi, India
